What These Terms Cover
These Terms of Use apply to your use of NOTBOX hardware, firmware, software features, local web interface, update services, website content, and API documentation provided by Heller Networks LLC ("Heller Networks," "we," "our," or "us").
By using NOTBOX or related services, you agree to these terms.
Authorized Use Only
NOTBOX is a network testing and impairment appliance. You agree to use it only on networks, devices, and systems that you own or are authorized to test.
- Do not use NOTBOX to disrupt or inspect networks without permission.
- Do not use NOTBOX for unlawful activity.
- You are responsible for how the device is configured and where it is inserted into a network.
Product Purpose and Operational Responsibility
NOTBOX can intentionally introduce latency, packet loss, jitter, bandwidth limits, and other network conditions for testing. These settings may interrupt traffic or cause systems to behave unexpectedly.
You are responsible for:
- Using the device in a safe test environment
- Verifying port placement (MGMT / UPLINK / DOWNLINK / LOCAL) before applying tests
- Avoiding use on production systems unless you intentionally want to test production behavior
Ownership and License
Heller Networks retains ownership of NOTBOX software, firmware, design, branding, and related intellectual property, except for third-party/open-source components that are governed by their own licenses.
When you purchase a NOTBOX device, you own the hardware. The embedded firmware and software are included for use on the device and may not be separated, extracted, or redistributed independently, except where permitted by applicable open-source licenses (see below).
- You may use the product for its intended purpose: network testing, validation, and diagnostics.
- If you transfer or sell the physical device, the right to use the included software transfers with it.
- You may not redistribute the firmware or software independently from the device, except where allowed by applicable open-source licenses.
- You may not remove product branding, legal notices, or attribution information where prohibited by law or license.
Open Source Components
NOTBOX includes open-source software components. Those components are licensed under their respective open-source licenses, which continue to apply.
Open-source notices and license disclosures are provided separately from these Terms (including the device's open source license listings and related documentation where available).
Reverse Engineering and Proprietary Code
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of Heller Networks proprietary software components, except to the extent that applicable law expressly permits such activity regardless of this restriction.
This restriction does not apply to open-source components included in NOTBOX, which remain subject to their own license terms.
Firmware Updates and Device Services
NOTBOX may check for and install firmware updates when you choose to use the update feature. Firmware updates may improve reliability, fix bugs, change behavior, or update disclosures/documentation.
- Update availability may vary by device model and firmware version.
- We may stop publishing updates for older releases or hardware over time.
- You are responsible for testing updates before broad deployment in your environment.
Compatibility and Third-Party Environments
NOTBOX is designed to work with common networking equipment and storage environments, but compatibility can vary based on your routers, switches, clients, NAS devices, SMB/NFS configuration, firewall rules, and other third-party systems.
We do not guarantee compatibility with every network topology, storage server implementation, or operating environment.
Warranty and Disclaimer
NOTBOX hardware is covered by a limited warranty as described in our Warranty & Returns policy.
Unless a separate written warranty applies to your purchase, NOTBOX software and firmware are provided on an "as is" and "as available" basis.
To the maximum extent allowed by law, Heller Networks disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
This section does not override any non-waivable consumer rights that apply in your jurisdiction.
Limitation of Liability
To the maximum extent allowed by law, Heller Networks is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or downtime resulting from use or misuse of NOTBOX.
To the extent liability cannot be excluded, Heller Networks' total liability will be limited to the amount you paid for the specific NOTBOX unit or related service giving rise to the claim.
Data, Privacy, and Network Information
Depending on how you use the device, NOTBOX may process network test traffic, packet captures, connection metadata, and configuration data locally on the device or on network storage you configure.
Update checks, activation workflows, and website contact forms may communicate with Heller Networks infrastructure. You are responsible for understanding your own data handling obligations when using packet capture or network diagnostics in your environment.

Returns, Support, and Service Expectations
Unless otherwise stated in writing, NOTBOX is sold as a self-managed appliance and does not include a guaranteed response time, managed service plan, or continuous support availability.
Support is provided on a reasonable-effort basis through published contact channels. Return, refund, and replacement handling may vary by purchase channel, reseller, and shipping region.
If you purchased through a reseller or marketplace, that seller's return policy may also apply.
Termination or Suspension
We may suspend access to hosted services (such as update endpoints or support systems) if necessary for maintenance, abuse prevention, legal compliance, or service protection.
These Terms do not grant a guaranteed minimum service term for hosted update infrastructure unless separately agreed in writing.
Changes to These Terms
We may update these Terms from time to time. The latest version will include an updated "Last updated" date. Continued use of the product or related services after changes are published means you accept the updated Terms.
Export Compliance
You agree to comply with all applicable export control laws and regulations, including United States export controls, when using or transferring NOTBOX products.
Authority
By using NOTBOX or related services, you represent that you have the legal authority to agree to these Terms on behalf of yourself or the organization you represent.
Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes will be handled in the appropriate state or federal courts located in Michigan.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.
Entire Agreement
These Terms, together with the Privacy Policy and Warranty & Returns policy, constitute the entire agreement between you and Heller Networks regarding NOTBOX, and supersede any prior agreements or representations.
